Wanted to get this model since I started collecting.
BMW 3.5 CSL 24 Hours of Daytona by Minichamps. Dealer Edition.

Bought it on eBay.
Listing said it is "Brand new in original box, never displayed".
Paid € 95 + € 25 shipping.
Seller's nickname on eBay - drroem.

It arrived and looks like it isn't exactly new.


Decals are damaged all around the model.






More damaged decals and a deep scratch.


Paint chips on roof spoiler.

Messaged seller and he said he can't do anything until he gets back home but that would be after PayPal protection deadline.
Wanted to open PayPal claim one or two days before deadline but other things got in the way so I didn't :(
Messaged seller asking for € 40 refund cause I think it was quite a serious damage to original model since I wanted to get it in this particular livery to have it along my AutoArt BMW 3.0 CSL.
He said it is too much, almost half of the price he sold it for which is € 95. He offered € 20.
I refused and said I'd settle for €30.
Since then he isn't replying.
First time I left negative feedback on eBay.

Am I right or am I wrong?
It is his only negative feedback in a long time.

IMO, nothing wrong with you leaving negative feedback. Seller seems like a total jerk

Hei, is this guy from the Netherlands? If so, I bought 4 models from him about 2 months ago. All mint and as described. Really nice guy IMO, he actually cut me a good deal on the 4 models. So I do not know what went wrong in your case, why he was not honest with you.

As a buyer, I always try to leave feedback at the very end of the dispute, because that's when I know if we get to a fair resolution or not, if seller is willing to take responsibility or not. Some sellers may take a while to get back to you, things always can happen. For example, few weeks back I received a model that got damaged during shipping. Tried to get in touch with the seller, and nothing. After about a week I opened a case with Ebay and few days later the seller gets back apologizing and telling me that he fainted while driving, hit a tree, ended up in the hospital with a stent in his heart. He refunded me immediately, slightly more than what I paid and told me to keep the model. Not saying that you have to believe all the stories the sellers give you, some can be very well fabricated. But this one seemed genuine based on the seller later actions.

So I like to make sure that seller and I exhausted all the possible still positive outcomes before I leave a negative. If you guys get to a resolution and you feel good about it, then I would revise the neg feedback.

Give him few more days and see what happens...

Sorry for the damaged model! Hope things will workout for you.

IMHO, don't feel bad for leaving a negavtive feedback if this guy us a jerk. I've done that a few times before because some sellers refuses to work with the buyer after he or she has received payment.

Sorry to hear about this. =/ In the future, always look after yourself by keeping track of the deadline to file an ebay/paypal dispute. If there's a possibility of having to do so, then go for it. You can always cancel a dispute at anytime.

For this reason, I will no longer be buying / selling on ebay, and will purchase either from like-minded collectors of DX or vendors of DX. I hope for a positive outcome my friend. (Personally, I'd just take the 20 euro and be done with it.)

Shame that the deadline passed, that thing ain't new at all. The seller was out of order listing it as new etc. You are right to leave a neg as they didn't want to sort it out.

To me looks like the model was damaged before being shipped.
I would understand if small part of decals flaked off during shipping but not all of them at the same time.
There are few more spots around model which I didn't show.
Also paint chips and a very deep scratch on the side make me think that the seller knew about condition of the model.
He received couple more neutral feedbacks which say models aren't as described but he refunded them.
Probably they opened PayPal case.

Usually he is fast with replies. But at some point he just stopped answering.
I gave him few days.

In my opinion, you shouldn't let one transaction deter you from using eBay. I wouldn't have half the models in my collection without it. As long as you do your homework and know the system, you'll be fine.

He seems to be BMW enthusiast and I hope he'll restore his old car which is most likely Bavarian.
Again my feedback is the only negative out of many so he seems to be trustworthy seller.

It is probably bad luck and a little lack of attention that led to this otherwise looks like you can trust that seller.

Ok Sanchez, I will leave it as is. If he was not willing to get to a fair resolution and didnt even respod to your msg, then he deserves the neg, so do not feel bad!
