Guys,

Being having massive issues with this mob. Apart from their extreme poor level customer service provided and manipulation of email conversations by their customer service lead which began for nearly a month, I decided to cancel all my pre-orders and accept there 20% re-stock fee as part of there Terms & Conditions. I requested for money to be wired back into my PayPal account within the 48-72 hours...This was over a week ago...they are stalling...and after reading various posts by people who had issues previously its really a waiting game with this mob.

I currently reside in Australia, does anyone know whether I should or can pursue advice by:

1. Lodging a compliant through PayPal?
2. Lodging a compliant to Attorney General Office Moorpark CA?? is it possible for a person that doesnt reside in the USA?
3. Lodging a compliant to Better Business Bureau Santa Barbara?

Any advice for this this diecast enthusiasts? Any contacts or email addresses that you can recommend?

I would do all three! BTW, the topic was moved as it is a very specific subject and does not belong in the "General" section.
How can they charge you a "re-stocking fee" if they haven't delivered the models?

Thanks acisne... I dont know why they would, but its part of there T&Cs...

PayPal - Ok with
BBB - website looks straight forward, hope they can hear my complaint from abroad
Attorney General Office Moorpark CA - does anyone know of the process and can assist me??

The AG should have a website where you can download a complain form. How about contacting the Australian Embassy and tell them you were defrauded? Don't mention the amount, but they might contact the State Dept to make a call.

It is situations like this that would make me rather eat a pile of garbage than to own one of their models. If it is not heavily discounted where I know they lost money, it won't make it in my collection.

Ok thank you again. I will go the AG website and see what I can find...This sort of service is unheard of from other manufacturers...this company is shocking to say the least!

if anyone else is experiencing issues, and have done something please post here...I would appreciate any advice..Hopefully others can learn from these posts.

WOW...looking at the BBB website has Exoto on there database...See below

15 complaints closed with BBB in last 3 years | 4 closed in last 12 months

Edited..i had 2 & 3 the other way around...received a reply from the BBB...they have notified Exoto, now its a waiting game...

jimst10, I'm very sorry to hear that you've been stolen from by this fraudulent organization. I think you'll find that we have allot of respect for collectors who actually take the time to stand up and take action against the likes of Exoto. Far too often anymore we see an attitude of "Oh well, karma (or some nonsense) will catch up to them. There's nothing I can do." I highly encourage you to file a complaint with the Calif. AG and make sure to let them know that you know for a fact that there has been a pattern of deceptive business practices over a period of many years by Exoto and specifically, Tony K.

So is your PayPal complaint an actual dispute? Or is the transaction too old? Restocking fee for a pre-order? BullSHIT!!!

This is despicable behavior for an individual and absolutely unbelievable for a company. I do look at their website and came close to buying a set, not now though. I just wonder if they monitor this forum.
I'm pretty sure they are aware of what is said here. If you "Google" Tony K., then you can usually find links to testimonials of screwed customers from this forum and others. It's common knowledge amongst the die-cast hobby world that this outfit is bad news, and that it's "at your own risk" when you give them your hard-earned money. I'm just astonished that Exoto hasn't cleaned up their act in the slightest. You would think that they would want to keep customers... but, apparently, they aren't concerned with their reputation as much as they are money (which go hand-and-hand). This stuff will catch up with them at some point, and we will see them close their doors - soon.

just lodged my complaint to the Attorney General Office Moorpark CA...I lodged a dispute with PayPal a few days ago..they are investigating the issue. I had two pre-orders (I know..terrible mistake)...and after 1 months worth of horrible communication i decided to cancel my pre-orders and accepted the 20% re-stocking fee...even till this day i have not seen my money back...they are giving me and Paypal the run around...they even said to PayPal that they have shipped the items (can you believe that?) i immediately sent PayPal my order history linking to PayPal transaction IDs...Exoto has no where to run...except for down hill!

next...i will be contact the local Ventura County Sheriff's Department, Moorpark, CA

What a unbelievable way to run a business!!! How can they possibly do this to customers and sleep at night???? I hope they get exactly what is owed. I for one will NEVER purchase from them again.

This doesn't surprise me, earlier this year I ordered the Alfa 159 from them as it said it was in-stock and I knew a couple of other people that had received them recently. So I order it and a month goes by and nothing. I call them and the operator went through a checklist of different things to tell me. I called BS on their excuses and decide to just cancel and the cs rep said that I would have to pay an order cancellation fee. I told her that I have screen prints of my order confirmation page and their terms and conditions and it didn't state that. So I tell them that if I don't get it soon I will be raising hell. Next thing I know I get an email from Tony K. saying my car is the mail and that I will find that the wait was worth it when I behold it- no joke (I should see if I still have it). Anywho, I wound up receiving it a few days later. So from now on I will only buy from them from a third party.

Side note, a couple of months ago they started full page ads selling their Alfa through Road and Track. I wonder how many complaints R&T received from non-deliveries.

Maybe as an alternate solution you could threathen them by saying you will be contacting their advertisers about non-deliveries.

Thanks Guys...it is now a waiting game...Tony K is playing games and stalling at every angle. Im still waiting on responses from PayPal, BBB, and AG OFfice. I will take up all the suggest advice and action if necessary.
